Acceptance of Terms & Agreements

Thank you for choosing to stay with Priya Living. We look forward to your visit and will do everything possible to make your stay enjoyable.

All reservations and payment of charges are subject to these Terms and Conditions and the Lease Agreement provided in this document that are deemed to have been accepted in full by you, the booker, and all persons/guests in the party involved in the booking process. Bookings and payments purchase the right to be a guest within a Priya Living apartment for and not exceeding the agreed-upon number of nights specified in the booking confirmation. The Terms and Conditions and Lease Agreement are binding. Acceptance of the agreement is implied and activated by payment for the booking and entry to stay in one or more of our apartments.

Priya Living reserves the right to refuse admission to any guest who has a booking if there are concerns about the security of its properties or the safety of its staff and any subcontractors. If you break any of the rules or terms of stay in this document, Priya Living reserves the right to terminate residency without a refund. Guests are expressly forbidden from using the address of any Priya Living apartment to obtain goods or for use with a credit agreement of any kind or for any unlawful activity.

Reservation Policy

Subject to the commencement of operations by Priya Living at Gurugram, we guarantee your reservation until the day of arrival. After that time, we will no longer guarantee the reservation and may reassign your reserved apartment. We will only charge your credit card 24 hours before your arrival for your confirmed reservation date, which gives you ample flexibility to make changes before you arrive.

We will charge a security deposit 24 hours before arrival, which will be 20% of your entire stay. Any deposit shall be refunded if Priya Living cancels the booking because of the non-commencement of operations. Please see the section on Cancellations below for details about the Security Deposit. Priya Living can cancel your reservation if we do not receive all prepayments on your credit card 24 hours before your arrival, and we will email you a cancellation confirmation immediately.

We welcome children, but you must be 25 years old and present to book a room. We require a valid passport or Adhaar Card upon check-in. All requests to reserve an apartment must include the first and last names of all adults occupying the room and a valid credit card to guarantee arrival. Our room rates are subject to change (but consistently excellent). All rooms are subject to an 18% GST. We welcome families and friends. When booking, keep maximum occupancy rules in mind—two people max for rooms with a single bed (Queen or King) and four people max for rooms with multiple beds. For babies, we have pack-and-play and cribs available upon request, subject to availability at $2 per day.

Cancellations
Cancellation Policy

Please review our cancellation policy carefully. We rarely make exceptions to it. So, to avoid any misunderstanding, we would be grateful if you could observe the following:

The guest must email a cancellation request with a 24-hour notice, stating the reservation number to the following email: reservations@priyaliving.com. All reservation cancellations are confirmed via email immediately.

  • If the guest cancels more than 24 hours in advance, we will refund the total reservation amount.
  • If the guest cancels less than 24 hours in advance, 100% of the prepayment is non-refundable.
  • If the guest arrives and decides to leave early, the nights not spent after the cancellation occurs are 100% refunded.
  • In case of a no-show, we will charge the total price of the reservation, and it is non-refundable. We treat non-arrivals and no-shows as a cancellation, and you will not be entitled to any refunds. Please note that transaction fees are not refundable in the event of a cancellation.
Booking
Terms of Booking

All prices quoted are the published rate, excluding applicable taxes. All taxes are quoted separately based on the room rate. When we authorize your payment and send you a confirmation, your reservation is complete. The standard booking price includes the following:

  • Airport pickup and dropoff
  • Fully furnished apartment
  • Towels, bed linens, bathroom supplies, and hairdryer
  • Utilities (water and gas)
  • Breakfast buffet
  • Wi-Fi/Internet access
  • Flatware and utensils
  • Iron and ironing board
  • Daily cleaning

We mention all other amenities and facilities on our website and correspondence. Some may incur additional charges.

Priya Living is in the process of creating community living spaces in Gurugram, India, and the utilization of your booking is subject to the commencement of the operations of such community living spaces. Your reservation books you an apartment type, not a specific apartment. Each type includes apartments of similar type, size, and equipment; however, interior designs may differ. Reservations can only be taken and confirmed by a credit card authorization for the entire stay. We also authorize a security deposit of 20% for your entire stay. You can pay using debit and credit cards, bank transfers, or PayPal. We will process your booking immediately after receiving your request. Once you receive a confirmation email from reservations@priyaliving.com your booking is verified.

We reserve the right to refuse any booking at any time. Please provide a valid contact telephone number and the name of all the guests when booking, including whether they are adults or minors. When you book, you will need a valid credit card to cover any additional charges incurred and rent (all subject to agreement with Priya Living). Priya Living reserves the right to deduct from your credit card all amounts chargeable under these conditions, including, but not limited to, further accommodation charges. When you receive our confirmation email, please check the details carefully. Please inform us immediately of anything you need to correct. We cannot accept any liability if you do not notify us of any inaccuracy in the documentation. If there is an error in the confirmation or invoice, we reserve the right to correct it within seven days of receiving your email. If your arrival date is within seven days of booking, we will do our best to accommodate your request as soon as possible.

Payment
Terms of Payment

All payments are due in advance of occupation by credit or debit card for your full stay. We will charge your credit card 24 hours before arrival. For extended stays, subsequent charges will be due every 30 days after arrival. We accept major credit and debit cards, bank transfers, and PayPal. We can only confirm reservations after we receive the guest registration details. If we cannot authorize funds from your credit card, we could cancel your booking. If payment does not reach us at the requisite deadline, we reserve the right to suspend or cancel any booking made.

In the unlikely event that the accommodation ceases to be available for the booking period, Priya Living shall try to arrange alternative accommodation. If this is not acceptable to the guest, we will refund all monies, and the liability of Priya Living shall then cease. Priya Living reserves the right to refuse any booking at its discretion without stating a reason or to cancel, modify, or alter arrangements made by the guest. In this instance, we will give you a full refund; however, Priya Living will not be responsible for sourcing replacement accommodation or any costs incurred.

Children, Family & Friends
A Family-Friendly Community

We are a family-friendly community and encourage you to welcome your family and friends to visit and stay with you per our guest policy for the room type and size. Please notify us at least 24 hours before your arrangements, and we will charge you accordingly. One child under 8 eight years old may stay free of charge. Based on availability, children’s cots or cribs are available at $2 per day. Members should always accompany their guests. All guests shall maintain the decorum expected of everyone at Priya Living Flower Valley.

Priya Living Clubhouse
Club Rules

Although Priya Living Flower Valley and the Club at the property welcome families, it is important to remember the guidelines for etiquette regarding children to ensure enjoyment for all members. Parents are responsible for the conduct of their children and their guests. Members will pay for any damages to the property due to their negligence or the negligence of their children or guests. Priya Living members will have access to the Club at Flower Valley. All members shall pay for their guests who use the Club or any amenity with a fee. We will issue you a receipt when you pay, which you must show before using the facility. You can use it for one facility for one use only. Members must make a new payment each time they use the amenities that require payment. The amenities can generally be used for two hours daily unless the Management decides to extend it. All guests shall respect the privacy of other residents and all facilities of the Club. All guests shall treat the staff courteously. Please direct any complaints to the Club Manager and not the staff member. All guests will wear appropriate attire while using any Club facility. All guests shall enter their details separately in the register available at that facility.

Security & Damages
Security & Damage Deposit

Guests are responsible for taking all reasonable care of their apartment and its fixtures, fittings, and contents. Guests agree to keep accommodations in the same state of repair and conditions as at the commencement of the stay. We charge a security/damage deposit of at least 20% for your entire stay 24 hours before arrival. We use the deposit to cover against loss or damage to the apartment, its fixtures and fittings, and contents (e.g., damage caused by negligence or deliberate acts of vandalism by a guest or their party); additional cleaning costs if you leave the apartment in an unacceptable state; breaches of the smoking and other regulations; or causing a disturbance to other residents). You need permission before using the apartments for parties or other non-residential activities.

Deposits also may be used by Priya Living in the event of unauthorized extra guests using the apartment and facilities, the loss of keys, or unauthorized removal of items or transfer from one apartment to another, for example, but not limited to bedding, towels, linens and kitchen equipment. We recommend that all guests review equipment/condition during check-in. We will accept notification of damage found as pre-existing within the initial 48-hour period following the guest’s arrival. Should the damage come to light after the guest’s departure, we reserve the right to charge the card details provided upon arrival. Where the guest denies responsibility for the reported loss/damage, we will accept the word of our staff as binding and deduct the appropriate amount from the deposit. Guests should note that where applicable, charges for damage will include costs for the apartment being out of service.

Special Requests
Special Requirements

We will endeavor to help guests with special requirements. Please ensure we are informed in writing of any special requirements when booking so we can help you select the most suitable apartment for your needs. Although we will endeavor to meet any reasonable requests, we cannot guarantee that we can meet all requests. We cannot accept conditional bookings, namely, any booking specified to be dependent on fulfilling a particular request.

Prices & Taxes
Rates

To our knowledge, the rates we advertise are correct at the publication date. However, we reserve the right to change any rates occasionally. Before your booking is confirmed, rates quoted are based on prevailing rates but are subject to change. Once we confirm a booking, we will only change the rate quoted if you amend the booking or our cost of supplying the accommodation changes due to tax changes or currency fluctuations beyond our control. A GST of 18% will be charged on all goods and services as required by law.

Booking Alterations
Amendments to Booking

We pride ourselves on our flexibility and are happy to amend your booking (e.g., change of dates, length of stay) wherever possible, providing the notice periods (see Cancellations) have been adhered to. Extensions may be possible depending on availability. Should the same apartment not be available, we shall advise you of any alternative options. Please email us on time for any changes, extensions, and cancellations. Accordingly, you will be liable to pay us the full booking amount if it is not changed, extended, or canceled via email.

Changes to Booking

On occasion, it may be necessary to reassign your apartment. In most cases, this will be an identical apartment in either the same or similar development; however, this may not always be possible. We will inform you of any changes before arrival. If none of these options are acceptable, you may cancel the booking with no notice terms and receive a full refund, which will be a full and final settlement. In the unlikely event that we need to cancel your booking, we shall attempt to find a suitable alternative for you for the same price. Should this not be acceptable to you, or if we cannot find a suitable option, you will receive a full refund. We regret that we cannot accept liability for any loss, damage, or additional expense where a booking needs to be altered or canceled, or we are unable to perform our obligations due to events that could not have been reasonably foreseen or avoided, e.g., war, terrorist activity, natural/man-made disaster, adverse weather conditions, etc.

Extensions

If you wish to extend your stay, please give us as much notice as possible to facilitate your request. All extensions are subject to availability and rate change. If you give us appropriate notice to extend your stay, we reserve the right to take all additional payments and charges from the credit/debit card used to make the original booking. We will do our best to accommodate your new plans, including relocating you to a similar apartment if necessary. Bookings are not transferable to different dates. Please request changes to your reservation by giving the appropriate notice at least 24 hours before your updated reservation begins.

Group Bookings
Group Bookings & Cancellation

If you need to cancel your group booking, you are entitled to do so with no charge, provided you cancel the booking in writing via e-mail (reservations@priyaliving.com) with the following conditions.

  • A 24-hour minimum cancellation notice.
  • We also need a minimum notice of 24 hours for extensions or early departures.

Group Booking
We consider a group to be five or more apartments booked in the same property for similar dates. Special conditions may apply, which we will share with you when you make your reservation. Please note that cancellation charges for Group Bookings may differ from those in the Cancellation section.

Injury & Liability
Personal Effects/Personal Injury/Insurance

Priya Living will not be responsible for any damage or loss to your belongings or any personal injury that may occur during your stay. Neither we nor our representatives can be held responsible for any circumstances beyond our control, including (but not limited to) mechanical breakdown, illness, or failure of any public service supply. We recommend that all guests obtain appropriate travel and personal insurance coverage, including contents coverage for their personal effects, as this is not provided or included as part of your booking. We are not liable for theft or damage to any property left in a Priya Living apartment or anywhere else. Guests must ensure that apartment doors and windows are securely locked when they are out.

Liability

We use all reasonable efforts to maintain high standards and set up the apartments correctly. We will take great care to organize your stay as comfortably as possible. However, we are not liable and cannot be held responsible for the actions of other residents/owners or suppliers involved in your stay. All warranties, conditions, and other terms implied by statute or common law or otherwise are fully permitted by law, excluded from any contract with us, and these conditions shall apply in their place. However, nothing in these terms and conditions shall affect your statutory rights as a consumer. Nothing in these terms and conditions limits or excludes our liability for death or personal injury resulting from negligence, any damage or liability incurred by you due to fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law.

Subject to the paragraph above, we shall not be liable for any loss of profits, loss of business, depletion of goodwill or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of use, loss of corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.

Apartments
Your Apartment

All apartments are occupied as serviced apartments and are only to be used as temporary or residential accommodation for you. They are not for use as guests' principal home or residence; you will not be entitled to any tenancy rights or title for your stay. There is no relationship between landlord and tenant, and no statutory security of tenure exists now or when the period of occupation ends. If you or any member of your party fails to vacate at the end of the period, you will be charged the appropriate accommodation charges for the continued period of occupation. No persons other than the guests have the right to use the apartment. The number of beds in the apartment determines the maximum number of guests. We may refuse access to the accommodation or reserve the right to add additional charges if you exceed the maximum number of guests.

Apartment Provision

Priya Living will provide a fully furnished apartment as specified or of a similar standard and location when you book for dates at a quoted rate. We will maintain and service all apartments, including the daily cleaning and linen change. We will pay for all utilities. The cleaning is a daily refreshment of linen, towels, and light dusting/vacuuming. It is not a deep cleaning by our housekeeping team. Priya Living operates a policy of continuous improvement and reserves the right to change/move furniture in all apartments. While we make every effort to ensure the accuracy and currency of all photographs on our Website, it may not reflect changes to furnishings. Please use other designated areas of the Central Park Flower Valley township under the same terms and conditions as Priya Living.

Checking In/Out
Check-In

Check-in is from 3 p.m. local time, and check-out is by 11 a.m. local time on the day of arrival. Earlier check-in or later check-out times can only apply with prior approval by Priya Living and based on availability. Please do not assume you can check in early or stay later than our check-out time without having made your request known to us; changes are subject to availability and may be subject to additional charges. You can check in at any time from 3 p.m., local time. Apartment keys will be waiting for you at the reception desk in the first-floor lobby of The Rooms. Please note that you will first enter via the secured main entrance to the Flower Valley township and then drive to The Rooms.

The balance of the full apartment rental amount for the first month, or your length of stay, whichever is shorter, is payable on arrival at check-in time. Please note that check-in is only possible after we receive the full payment for the apartment for the first 30 days or the duration of the reservation, which is lower. The amount will also include a 20% security deposit for your entire stay 24 hours before check-in. You will receive an apartment key at check-in time.

During check-in, our concierge will provide information such as the location of nearby shops, amenities, services, dining options, sights you may like to see, places to go at night, etc. Please always ask our receptionist for anything to make your stay more enjoyable and convenient.

Please bring your booking confirmation upon arrival and, where notified, contact us in advance to confirm the arrival time. Guests are responsible for having all the relevant information provided by Priya Living, including the confirmation number. Upon check-in, guests will complete an arrival form which provides Priya Living with all relevant contact details as well as confirmation by the guest that they agree to be bound by Priya Living’s terms, conditions, lease agreement, and policies which are specific to how we would expect them to treat the apartment.

Returning/Lost Keys

Please return your keys at your scheduled checkout date and time. Please lock the door and post the keys as instructed. Please note if you do not return your key, there will be a $25 charge per key. As noted, if you lose your keys during your stay or lock yourself out of your apartment and require re-entry, a call-out fee of $25 and the cost of any replacement keys shall be applied. We will charge this amount to your credit card on file within 24 hours.

Facilities & Services
Housekeeping

We will clean your apartment daily. When you arrive, we will determine a time for your daily housekeeping. Daily housekeeping includes linen and towel changes, a freshly made bed, light cleaning, and tidying up. We will also replenish toiletries, tea, and coffee and provide two one-liter water bottles. Please clear the floors and surfaces to allow our housekeeping team to clean thoroughly. Please only throw waste in the bins provided. Our housekeeping team will empty the waste bins daily. During your stay and departure, please leave your apartment in a reasonable state of cleanliness.

NOTE: Our housekeeping team is not responsible for your mess, personal belongings, or the washing of crockery/cutlery. However, our housekeepers may wash a few items at their discretion on the service day. If you require additional cleaning time due to the condition you/the guest leave the apartment in, you will incur a charge for the extra hours spent by housekeeping.

Access & Security
Rights of Access

Representatives and sub-contractors of Priya Living have the right to access the property at any time to carry out essential maintenance/repair work, inspections, or viewings. We will contact you before entry and with the minimum inconvenience; however, we reserve the right to access the apartment at any time without prior notice if necessary (e.g., to investigate the report of a leak to another apartment).

Security

We will provide guests with one set of keys/access cards per adult to access the property and the apartment. You may request additional sets if needed. There is an additional charge of $25 per key for replacements or to provide access due to lost or forgotten keys. As Flower Valley is a gated community, guests must provide their names and possibly identification when they enter the Flower Valley township. The guest is responsible for keeping keys secure and the apartment locked. If the guest does not return all the keys at checkout, we will arrange to change the apartment locks. We will charge the guest $25 per key. If the guest loses their keys during their stay, they must notify Priya Living immediately, and we will arrange for the apartment locks to be changed. If the apartment is not kept secure, the guest will be held responsible for any loss or damage to the property or Priya Living-owned possessions. Priya Living does not insure a guest’s belongings. Should the guest require assistance between 7 p.m. and 9 a.m. due to lost keys, mislaid keys, or being locked out of their apartment, Priya Living reserves the right to charge an additional out-of-hours call-out fee.

Service Interruptions
Interruption of Service

We will make every effort to ensure that guests enjoy a peaceful stay; however, we cannot guarantee or be held responsible for any failure or interruption of services to the apartment or the building, including electricity, air conditioning, water, or any damage to broadband/ internet and other communications, including disruption or noise caused as a result of repairs in process in another part of the property. Where we are made aware of such failure or interruption, we will attempt to rectify such services within a reasonable period at our apartments and use reasonable efforts to ensure any preferred supplier is made aware of and fixes issues within a reasonable period.

Our management team is available to ensure your stay is as comfortable and enjoyable as possible. Contact details and working hours are made available on arrival.

Your Responsibility
Guest Responsibility

We expect guests to comply with any regulations for using the apartment and all the amenities at Flower Valley. These regulations are also available in the guest information folder in the apartment. If any guest breaches these conditions or the rules, we reserve the right to request a guest vacate their apartment immediately and keep their security deposit as needed.

Smoking
No Smoking

All of our apartments at all locations are strictly non-smoking. Smoking is also prohibited in all indoor zones and most areas of Flower Valley. We expect guests to comply with smoking regulations throughout the property as enforced by the security team. Guests found to be smoking or evidence of smoking indoors found either during your stay or on departure will incur an instant cleaning fee of $250. Guests will also be fully responsible for any damages/burns, additional cleaning, or refurbishment work from smoke damage. We will use your credit card on file for any applicable charges or deduct it from your deposit. Priya Living Flower Valley is a non-smoking property. Smoking includes traditional methods and all electronic delivery systems, including vapes, vaporizers, vape pens, hookah pens, electronic cigarettes (e-cigarettes or e-cigs), e-pipes, and any variations of the preceding, regardless of the product’s name. Any smoking in the rooms or strong lingering smoking scents in rooms will result in a cleaning fee.

NOTE: Please be aware of the fire hazards associated with smoking, which will also be the guest's full responsibility should an outbreak of fire occur.

Pets
Pets Are Welcome

We allow pets at our locations at a fee of $1.75 per pet per night—however, please no dangerous animals. We expect guests with pets to clean up after them, and any costs caused due to pet-related damages, infestations, etc., will be charged to the guest in full, together with a $250 administration to the credit card on file or taken from your deposit. Priya Living also reserves the right to ask guests to leave if the pets are a nuisance to other guests.

Noise & Nuisance
Noise Levels

A noise curfew is effective at all locations between 10 p.m. and 9 a.m. Please kindly refrain from excessive noise levels/loud music at all times in consideration of other residents. Any complaints received could result in you being evicted immediately with no refunds due. These complaints include causing any sort of nuisance or disruption to fellow guests or using threatening or abusive behavior toward a member of staff on the phone, in writing, or in person. Guests are not permitted to use the apartment for illegal or immoral purposes. If the management team is called to respond to a nuisance complaint, Priya Living could charge an additional amount.

Nuisance Behavior or Complaints of Any Nature

Priya Living acts up and takes complaints of any type very seriously. For the safety and enjoyment of all our guests, we operate under a zero-tolerance policy and must respond to all complaints received, no matter their nature or cause. We will evict all guests immediately if we are obliged to act in the community's and its residents' interests. In this case, no refunds will be due, and we will not be held responsible for sourcing alternative accommodations or for paying any costs the guests/parties involved may incur because of the eviction.

Age
Age Restrictions

We only accept bookings for guests 25 years and over. Guests must provide proof of identification and date of birth in the form of a passport or Aadhaar card on arrival. We reserve the right to cancel the booking if the guest does not provide such proof.

Visitors and Occupants
Visitors

Guests are responsible for their visitors. Non-residents will not be allowed access to the apartments after 8 p.m. without prior approval.

Number of Occupants

At the time of booking, we will confirm the maximum number of guests residing in the apartment. We reserve the right to refuse entry or evict you if you breach this condition. We permit the use of fold-up beds when arranged through us, with a fee paid in advance of $5 per day and based upon availability. We will place the fold-up bed with bed linens in the apartment. We will apply a charge for the unauthorized use of any items or additional guests. The apartment cannot be re-let/sublet to any other group/party without the prior knowledge and consent of Priya Living.

Your Property
Lost Property

Upon your departure, please remove all your possessions from the apartment. We will retain lost items for up to one week after your departure. Please email us at reservations@priyaliving.com for inquiries regarding lost items. Where and when available, we can provide luggage storage at an additional charge if you need it for more than 24 hours.

Other Charges
Additional Charges

Damages
Guests are responsible for taking reasonable care of the property, fixtures, fittings, and contents during their stay. We expect you to leave the property in good condition upon departure. If accidental damage does occur during your stay, please let us know. We will advise you if any charges apply. We will report any damages or missing items found during or at the end of the stay. We will charge your credit card or deduct from your deposit to repair or replace any damaged or missing item. All costs will also incur a 15% administration fee on the costs incurred. If an apartment is left uninhabitable due to the extent of damage caused, we also reserve the right to charge for any loss in revenue in addition to the cost of the repairs. Photographic evidence will be provided wherever possible via email within 72 hours of departure, showing a detailed breakdown of the applicable charges and costs to rectify them. If the guest is uncontactable, damage caused by the guest to the apartment must be paid in full by the booker.

Additional Cleaning
Our housekeeping staff will attend to the apartment on your departure; however, we ask that you leave the apartment tidy and clean before leaving. If we require further professional cleaning due to smoking, needed upholstery or carpet cleaning due to spillages, etc., we will charge an additional cleaning fee per the quotation we receive.

NOTE: Any apartments requiring additional cleaning time will incur a fee for the hours spent by our housekeeping team at a minimum charge of $150, depending on the time and materials involved. Please note that cleaning due to smoking will incur a minimum charge of $250 per room.

Parking
Parking

By parking a vehicle at our facility, you (and your guests) are doing so on your own accord. Priya Living does not take responsibility or accept liability for damage, accident, or loss to your vehicle or personal property. However, we have round-the-clock security for Flower Valley, a gated community, and The Rooms, where Priya Living is located. The property is very safe. Also, we have surveillance cameras watching over the parking lot, so should anything seem amiss, let us know, and we’ll check out the footage.

We offer a limited number of covered parking spots within the basement parking garage of The Rooms based on availability. All guests must reserve car parking with the reservations team before arrival. Please ensure that you follow the instructions given to you at the time of booking carefully and ensure you have parked in the correct space for your apartment. Guests are responsible for securing any vehicles they park on the property. We recommend that a valid travel insurance policy covers travelers. The guests are responsible for ensuring that at all times:

  • Vehicles are parked in their designated space.
  • The parking permit provided (where applicable) is always clearly and fully displayed in the front window.

The vehicle's owner may be fined or their vehicle towed for failure to observe these parking conditions and guidelines. Priya Living cannot accept any responsibility for penalties, and it is the guest's responsibility to pay for any charges incurred. Owners park their vehicles at their risk. Priya Living does not accept responsibility or liability for any theft, loss, or damage, including but not limited to any personal property or loose items left within the vehicle while parked. The guest is responsible for ensuring that at the end of the booking,

  • The parking permit(s) and parking fob(s) provided are safely returned to Priya Living on the check-out day.
  • If a permit or parking fob is not returned safely to Priya Living, we reserve the right to charge a replacement cost of up to $25 per item.

If additional charges are made (including accommodation charges), and we cannot charge the credit card on file for any reason, we shall invoice the booker/lead guest, who will become responsible for payment of our invoice in full within 24 hours. Failure to pay will result in further action being taken to recover the due monies.

We take the health and safety of all our guests seriously. On arrival, you should familiarize yourself with the layout of the apartment and building and the health and safety procedures as detailed in your apartment. (More details are in the guest information folder.)

While we do all we can to look after and support our guests, Priya Living can in no way accept any responsibility should you contract the virus during the duration of your stay with us as we have no control over who you may come in contact with once leaving your apartment.

We may use your contact details to tell you about our services and apartments, including special offers that might interest you. If you do not want us to use your contact information, please let us know by email to reservations@priyaliving.com. Priya Living will process all information collected or properly obtained during the booking process per our Privacy Policy, which, with our Lease Agreement, is incorporated into these conditions. Telephone calls to Priya Living may be monitored and recorded as a security measure to help us train our staff and improve our service.

NOTE: Plumbing issues, electrical faults, air conditioning faults, non-access to your apartment, broadband connection issues, complaints about the apartment, and other customer service-related issues that are not considered to be emergencies and will not be dealt with if you call this number during out-of-office hours. This number is meant for extreme emergencies only. Please use this service only when necessary.

Rights & Waivers
Third-Party Rights

By agreeing to these Terms & Conditions, the Guest acknowledges and agrees that any rights, benefits, or obligations outlined in this agreement are intended solely for the benefit of the Guest and Priya Living. No third party shall have any rights or claims under this agreement, whether as a third-party beneficiary or otherwise, except as explicitly stated herein. The Guest further agrees not to assign, transfer, or otherwise convey any rights or obligations arising from this agreement to any third party without the prior written consent of Priya Living. Any attempted assignment, transfer, or conveyance without such consent shall be null and void.

Notwithstanding the above, Priya Living may, at its sole discretion, engage third-party service providers to facilitate certain aspects of the extended stay experience. In such cases, the Guest acknowledges that the use of these third-party services is subject to the terms and conditions of the respective third-party providers. Priya Living shall not be held liable for any third-party providers' actions, omissions, or breaches.

If any provision of these Terms & Conditions is determined to confer a benefit, or right upon any third party under applicable laws or regulations, Priya Living reserves the right to modify or terminate these Terms & Conditions to address such legal requirements, provided that such modification or termination does not materially affect the rights and obligations of the Guest under these Terms & Conditions.

The Guest agrees to indemnify, defend, and hold harmless Priya Living, its affiliates, officers, directors, employees, and agents from any claims, demands, actions, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to any breach by the Guest of the terms outlined in this "Third Party Rights" clause.

This "Third Party Rights" clause shall be governed by and construed as per local laws. Any disputes arising from or related to this clause shall be subject to the exclusive jurisdiction of Gurgaon, Haryana.

Waiver

No Waiver: The failure of Priya Living to enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing.

Specific Waiver: Any waiver of a particular breach or default shall not constitute a waiver of any subsequent breach or default of the same or similar nature.

Written Waiver: No waiver by Priya Living of any term, provision, or condition of these Terms & Conditions, whether by conduct or otherwise, in any one or more instances, shall be deemed to be, or construed as, a further or continuing waiver of any such term, provision, or condition or as a waiver of any other term, provision, or condition of these Terms & Conditions.

No Implied Waiver: A waiver of any term, provision, or condition of these Terms & Conditions shall only be effective in writing and signed by an authorized representative of Priya Living. The failure of Priya Living to exercise or enforce any right or provision of these Terms & Conditions shall not operate as a waiver of such right or provision.

Reservation of Rights: Priya Living reserves all rights, remedies, and defenses under these Terms & Conditions and applicable laws and regulations.

Lease Agreement
Lease Agreement

This Lease Agreement (hereinafter referred to as "Agreement") is executed on the date of the booking ("Execution Date") by and between: Priya Living India Private Limited, a private limited company registered under the Companies Act, 2013 and having its registered office at 9/126, Lower ground floor, Malviya Nagar, Malviya Nagar (South Delhi), New Delhi, South Delhi-110017, Delhi (hereinafter referred to as "Lessor," which expression shall, unless repugnant to the context or meaning hereof, be deemed to include its successors, affiliates, and assigns) of the FIRST PART; AND the guest (hereinafter referred to as the "Lessee," which expression shall, unless it be repugnant to the context or meaning hereof, mean and include their/its legal heirs and permitted assigns) of the SECOND PART.(Lessor and Lessee shall hereinafter individually be referred to as "Party" and collectively as "Parties". Capitalized words used but not defined herein shall have the same meaning as ascribed to such terms in the Resident Onboarding Form.)

WHEREAS:

  1. The Lessor is engaged in the managing of community living spaces and onboarding eligible guests in such spaces for an agreed duration.
  2. The Lessor is in the process of establishing a community living space in the Tower known as “The Room” at Central Park, Flower Valley, Sector 32, Sohna, Gurugram (“Complex”) consisting of various fully serviced units (“Unit”).
  3. The Lessee has approached the Lessor for seeking a Unit (as mentioned in Schedule -1) for a temporary use along with the associated common areas on a non-exclusive basis, for residential purposes ("Purpose").
  4. In consideration of the Lessee agreeing to pay the Rent (defined hereinafter) and all other charges as stated in this Agreement, the Lessor has agreed to enter into this Agreement with the Lessee on the terms and conditions stipulated herein.

NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

GRANT OF RIGHTS AND TERM:

The Lessor hereby grants to the Lessee leasehold rights to the Lessee for a period as mentioned in the Terms & Conditions of your booking, commencing from the Execution Date ("Term"). The Term may further be renewed by way of a fresh request in writing by the Lessee through the email, Website or mobile application and at such terms and conditions as may be determined by the Lessor and the Lessee shall not be entitled to any further stay in the absence of any such approved extension by the Lessor.

BOOKING AND RENT:

  1. A deposit amount as mentioned in the Terms & Conditions of your booking (“Deposit Amount”) shall be payable by the Lessee and shall be adjusted and maintained for the duration of the Term or till the date of the earlier determination. The Lessee shall agree to pay the Deposit Amount through the Lessor’s mobile application or Website (as defined herein) on the date of booking of the Unit (“Booking Date”) with a credit card authorization. The deposit will be collected 24 hours before their arrival date. If there is an increment of the Deposit Amount by the Lessor, the differential amount shall be paid by the Lessee along with Rent for the succeeding month.
  2. The Lessee shall also be liable to pay a monthly fee as specified in the Terms & Conditions of your booking (“Rent”) from the date of moving into the Unit as mentioned in the Terms & Conditions of your booking (“Move-In-Date”). The Deposit Amount shall be interest-free and shall be refunded after the completion of the Term and shall be subject to any deduction applicable on account of non-payment of Rent or any Other Charges as applicable from the Move-In Date.
  3. The Lessee agrees and undertakes to pay the electricity charges for his/her consumption, as per the actual meter readings at the rates intimated by the Lessor, stipulated under Schedule I of this Agreement or as may be raised from time to time by the Lessor.
  4. The Lessee shall also be liable for the payment towards other charges for maintenance, food, and other value-added services which may be availed as per Schedule-1 (“Other Charges”).
  5. The Lessee shall be liable to pay the Rent and Other Charges to the Lessor on a monthly basis in advance by the fifth (5th) day of each month of the Term by way of mobile application or website. Any delay in the payment of License Fee and Other Charges would be subject to late payment charges which may be adjusted against the Deposit Amount.
  6. In the event of failure to pay the Rent and Other Charges within a period of five (5) days from the due date by the Lessee, the Lessor shall have the right to terminate the Agreement immediately without any notice. In such event, the Lessee agrees to vacate the Unit immediately and the Lessor shall have the right to take over the Unit and recover any remaining dues after adjustment from the Deposit Amount.
  7. The Lessor may effect escalation in the Rent and Other Charges during the Term with or without notice to the Lessee or at the time of renewal of the Agreement and the Lessee shall be liable to pay the same. The latest Rent and Other Charges payable are available on the website https://www.priyaliving.com/communities/delhi/flower-valley/ ("Website"). The Lessee agrees to pay such escalated and additional charges and comply with the terms and conditions in relation to the same from the date they are updated /made effective on the Website.
  8. The license granted herein is personal to the Lessee and not for any other person including relatives and/or friends. If Lessee's friends or family are desirous of staying in the Unit, the same shall be permitted subject to such additional documentation and charges as the Lessor may specify from time to time on the Website or in person.

Forfeiture of the Deposit Amount
The Lessor shall have the right to forfeit the Deposit Amount and require the Lessee to vacate the Unit in the event:

  1. The Lessee is in breach of the terms of this license including non-adherence with the Additional Regulations by the Lessee as set out in Schedule 2 and in the Term & Conditions.
  2. The Lessee terminates this Agreement any time after the Execution Date and before the expiry of the Term, without prior written notice of 15 (fifteen) days to the Lessor through the Website or mobile application.
  3. The Lessee fails to pay the Rent within 24 hours before arrival or on the arrival date.
  4. A written complaint has been received from the housing society/association or Lessor in which the Unit is situated against the Lessee by another co-resident against the Lessee for violation of reasonable community living guidelines by the Lessee.
  5. The Unit is used for a purpose other than that mentioned by the Lessee.

COVENANTS OF THE LESSEE:

The Lessee covenants with the Lessor to comply with the below conditions:

  1. Provide all documents and information, including a passport or Aadhaar card, for police verification and co-operate with the Lessor for the same;
  2. Not store any hazardous goods such as inflammable items, firearms, lighters, fire torches, insecticides, or electric heating rods in the Unit or in the Complex;
  3. Not do anything in the apartment or the township which is or is likely to cause a nuisance to the other occupants of the units located in the Complex or prejudice in any manner the rights of the Lessor in respect of the Unit;
  4. Ensure that their guests visit the Unit during the specified visiting hours only and do not stay overnight;
  5. Allow the Lessor to inspect the Unit at reasonable hours without prior intimation and
  6. Follow the Rules as set out in Schedule 2.
  7. Comply with all the Terms and Conditions provided while booking an apartment.

TERMINATION AND CONSEQUENCES OF TERMINATION:

  1. Termination by the Lessor: The Lessor shall have the right to terminate this Agreement forthwith and without any notice in case of a breach of the terms of this Agreement by the Lessee. The Lessor may also terminate this Agreement by providing written notice of 24 hours via email to reservations@priyaliving.com, in which case the Deposit Money subject to the deduction as mentioned herein will be refunded back to the Lessee.
  2. Consequences of Termination and/or Expiry: In the event of termination or expiry of this Agreement, the Lessee shall: 1) Immediately pay to the Lessor all outstanding dues and charges as of the date of termination or expiry of this Agreement and vacation of the Property by the Lessee, whichever is later; and 2) Vacate the Unit and Property and remove all their goods and belongings therefrom.
  3. In the event of any delay by the Lessee to vacate the Unit (along with their belongings), the Lessor shall be entitled to recover damages equivalent to 2 (two times) the Rent for the period of such delay in vacation of the Unit. The Lessor shall have the right to seek recourse from the law enforcement authorities with respect to the removal of the Lessee and their belongings from the Unit.
  4. In the event the Unit is closed/locked by the Lessee consecutively for two days, without any intimation to the Lessor, the Lessee authorizes the Lessor to enter into the Unit and take possession thereof after providing intimation to the Lessee on the mobile number and email as submitted by the Lessee to the Lessor on the Booking Date.

GOVERNING LAW AND DISPUTE RESOLUTION:

This Agreement shall be governed by the laws of India. Each Party hereby submits to the sole and exclusive jurisdiction of the courts in New Delhi, India. In case of any dispute arising out of or in connection with this Agreement including any questions regarding its existence, validity, or termination, may be settled mutually and amicably by the Parties within a period of thirty (30) days, failing which, either Party shall be free to refer any such dispute or difference to a sole arbitrator, mutually appointed by the Parties in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time and in accordance with the Arbitration Rules of the Delhi International Arbitration Centre (DIAC). The award given by the sole arbitrator shall be final, conclusive, and binding upon the Parties. The seat of arbitration shall be in New Delhi, India. The language of the arbitration shall be English.

INDEMNITY
The Lessee shall indemnify and hold harmless the Lessor against all claims, demands, actions, suits, or cause of actions arising from any act or omission of the Lessee or arising out of breach of the terms and conditions by the Lessee under this Agreement.

MISCELLANEOUS:

  1. In addition to the terms of this Agreement, the Lessor may, from time to time, amend the internal rules governing the stay of the Lessee and the Terms and Conditions. The Lessee accepts such terms which may be made available on the Website or on the mobile application, which shall constitute an integral part of this Agreement.
  2. Notices, Communications: Any notice required to be given hereunder by the Lessee shall be in writing via email. Such a notice, if required to be provided by the Lessor to the Lessee, shall be through the email address (reservations@priyaliving.com) as provided by the Lessee to the Lessor. Such delivery shall be deemed to be confirmed when sent to the above address. Each of the Parties hereto shall notify the others of any change of email address within forty-eight hours of such change.
  3. Waiver: Failure of either Party at any time to require performances of any provision of this Agreement will not affect such Party's right to require full performance at any time thereafter. Any waiver by either Party of a breach of any provision hereof shall not be deemed a waiver by such Party of its rights or remedies or a waiver by it against any subsequent breach by the other Party.
  4. Severability: If any part of this Agreement is held to be unenforceable in any respect, the enforceability of the remaining portions of this Agreement will not be affected.
  5. Amendment: This Agreement shall not be subject to any change, amendment, or modification except by the execution of an instrument in writing by the Parties hereto and to the extent as modified on the Website.
  6. Costs: The Lessee shall bear the costs, including any applicable stamp duty pertaining to this Agreement.
  7. Counterparts: This Agreement may be executed in several counterparts, each of which shall be deemed an original, but all of which shall constitute one and the same instrument.

IN WITNESS WHEREOF THE PARTIES HAVE SET THEIR HANDS TO THIS AGREEMENT ON THE DATE, MONTH, AND YEAR MENTIONED AT THE DATE OF THE BOOKING.
